BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICE.

2. Eligibility and Account Requirements

2.1 Age Requirement

The Service is intended solely for individuals who are at least 16 years of age. By creating an account or using the Service, you represent and warrant that:

You are at least 16 years old
You have the legal capacity to enter into these Terms
You are not prohibited by law from accessing or using the Service

We do not knowingly collect information from or provide services to individuals under 16. If we discover that a user is under 16, we will immediately terminate their account and delete all associated data.

3. Description of Service

3.1 AI-Native Educational Platform

Blooming AI is an AI-powered educational platform that provides:

Personalized learning curricula and educational tracks
AI-generated learning activities and exercises
Automated review and feedback on user answers
AI tutoring sessions and conversational learning features
Interactive learning activities (including Feynman technique exercises, role-plays, and other pedagogical methods)
Progress tracking and learning history

3.2 Use of Artificial Intelligence

The Service is heavily reliant on artificial intelligence and third-party Large Language Models (LLMs). Our Service uses AI from multiple providers, including but not limited to OpenAI, Anthropic, Google, Mistral AI, Perplexity AI, and DeepSeek, to generate educational content and provide interactive learning experiences.

IMPORTANT ACKNOWLEDGMENTS REGARDING AI:

AI May Produce Errors: Artificial intelligence systems, including the LLMs we use, may generate inaccurate, incomplete, misleading, or incorrect information. AI-generated content should not be treated as infallible or authoritative.
No Guarantee of Accuracy: We do not warrant or guarantee the accuracy, completeness, reliability, or correctness of any AI-generated content, educational materials, curricula, feedback, or tutoring provided through the Service.
User Responsibility to Verify: You are solely responsible for verifying the accuracy of any information, educational content, or learning materials provided by the Service. You should independently confirm important information and not rely exclusively on AI-generated content for critical decisions or assessments.
Educational Purposes Only: The Service is provided for general educational purposes only. It is not a substitute for professional educational instruction, academic advising, or formal certification programs.
No Fitness for Particular Purpose: We make no warranty that the Service or AI-generated content is fit for any particular educational goal, examination preparation, or professional requirement.

BY USING THE SERVICE, YOU EXPLICITLY ACKNOWLEDGE AND ACCEPT THESE LIMITATIONS OF AI TECHNOLOGY.

4. User Responsibilities and Prohibited Conduct

4.1 Personal Data in AI Interactions

CRITICAL WARNING: When using AI-powered features that accept open-ended user input (including tutoring sessions, conversational activities, custom prompts, and learning exercises), you MUST NOT include personal data in your inputs.

Personal data includes but is not limited to:

Your full name, email address, phone number, physical address, or other contact information
Names or identifying information about yourself or other individuals
Financial information, health information, identification numbers, or other sensitive personal details
Any information that could directly or indirectly identify you or another person

You acknowledge and agree that:

User-generated prompts and conversations are processed by third-party AI providers located outside the European Economic Area, including in the United States and China
We do not transmit your account information, email address, or stored personal data to these AI providers, but we cannot prevent you from voluntarily including personal data in your prompts
If you include personal data in AI interactions contrary to this warning, you do so at your own risk
You are solely responsible for any personal data you voluntarily disclose in AI interactions
We have provided prominent warnings in the user interface to prevent inadvertent disclosure of personal data
We shall not be held liable for any processing, disclosure, or misuse of personal data that you voluntarily include in AI interactions contrary to our explicit warnings and instructions

4.2 Prohibited Uses

You agree NOT to use the Service to:

Illegal Activities: Engage in any activity that violates applicable laws, regulations, or these Terms
Harmful Content: Create, generate, or share content that is:
- Illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Promotes violence, hatred, discrimination, or harm against individuals or groups
- Contains malware, viruses, or other malicious code
Inappropriate Educational Content: Create courses, curricula, or learning materials that promote illegal activities, violence, hatred, or harm
Abuse of AI Systems: Attempt to manipulate, exploit, or abuse AI features to generate prohibited content or circumvent safety measures
Unauthorized Access: Attempt to gain unauthorized access to the Service, other user accounts, or our systems
Scraping and Automated Access: Use bots, scrapers, or automated tools to access the Service without our express written permission
Reverse Engineering: Reverse engineer, decompile, disassemble, or attempt to derive source code from the Service
Interference: Interfere with or disrupt the Service, servers, or networks connected to the Service
Commercial Exploitation: Use AI-generated content or the Service for unauthorized commercial purposes (subject to Section 6 on Intellectual Property)
Training Other AI Models: Use content generated by our Service to train, fine-tune, or develop competing AI models or services
Impersonation: Impersonate any person or entity or misrepresent your affiliation with any person or entity
Data Mining: Extract, collect, or harvest data from the Service or other users without authorization

4.3 Consequences of Prohibited Conduct

Violation of these Terms, including prohibited uses, may result in:

Immediate suspension or termination of your account without prior notice
Deletion of all your data and content
Reporting to law enforcement authorities where applicable
Legal action to enforce these Terms or recover damages

We reserve the right to terminate accounts at our sole discretion for any violation of these Terms, without warning, refund, or liability.

5. Payment Terms

5.1 Payment Processing

All payments are processed through Stripe, our third-party payment processor. By making a payment, you agree to Stripe's Terms of Service and Privacy Policy.

We do not store, process, or have access to your payment card information, bank account details, or other payment credentials. All payment data is handled exclusively by Stripe in accordance with PCI-DSS compliance standards.

5.2 Fees and Billing

Fees for paid features or subscriptions are described on our website and in the Service
All fees are in EUR (Euros) unless otherwise stated
Fees are non-refundable except as required by applicable law
We reserve the right to modify pricing at any time, with advance notice for existing users

5.3 Subscription Auto-Renewal and Cancellation

Subscription plans automatically renew at the end of each billing period unless cancelled
All subscription billing and renewals are managed through Stripe
You may cancel your subscription at any time through your account settings or by contacting us
Upon cancellation, your access to paid features will terminate immediately
No partial refunds are provided for unused portions of a billing period
You are responsible for cancelling before your next renewal date to avoid being charged

5.4 Taxes

You are responsible for all applicable taxes, duties, and governmental charges related to your use of the Service.

6. Intellectual Property Rights

6.1 Ownership of the Service

The Service, including all software, algorithms, designs, text, graphics, logos, and other content provided by Blooming AI, is owned by Blooming AI and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any ownership rights in the Service.

6.2 License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial educational purposes.

6.3 User-Generated Content

"User Content" means any content, data, text, answers, prompts, conversations, or other materials you submit, upload, or input into the Service.

6.3.1 Ownership of User Content

You retain ownership of User Content that you create and input into the Service.

6.3.2 License Grant to Blooming AI

By submitting User Content to the Service, you grant Blooming AI a worldwide, non-exclusive, royalty-free, sublicensable license to:

Store, display, and process your User Content as necessary to provide the Service to you
Use your User Content to improve and develop the Service, including training and improving our AI systems (but only in anonymized, de-identified form)

This license terminates when you delete your User Content or account, except where retention is required by law or where content has been anonymized and aggregated.

6.3.3 Responsibility for User Content

You are solely responsible for your User Content and the consequences of submitting it to the Service. You represent and warrant that:

You own or have the necessary rights to submit your User Content
Your User Content does not violate any third-party rights (including intellectual property, privacy, or publicity rights)
Your User Content complies with these Terms and applicable laws

6.4 AI-Generated Content

"AI-Generated Content" means content created by our AI systems, including curricula, learning activities, feedback, tutoring responses, and educational materials.

6.4.1 Current Status: Non-Commercial Use Only

At present, the Service does not permit commercialization of courses or learning content created on the platform. You may use AI-Generated Content for your personal educational purposes only.

6.4.2 Future Commercialization

We plan to introduce features that will allow users to commercialize educational content created on the platform. When such features become available, we will update these Terms to clarify ownership and licensing rights for commercialized content.

6.5 Feedback

If you provide feedback, suggestions, or ideas about the Service ("Feedback"), you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use, modify, and incorporate such Feedback into our Service without compensation or attribution to you.

7. Third-Party Services and Links

7.1 Third-Party AI Providers

The Service relies on third-party AI and LLM providers (including OpenAI, Anthropic, Google, Mistral AI, Perplexity AI, DeepSeek, and others) to deliver core functionality. We do not control these third-party services and are not responsible for:

Their availability, performance, or reliability
Changes to their terms of service, pricing, or functionality
Any interruptions or terminations of their services
The accuracy or quality of their AI outputs

7.2 External Links

The Service may contain links to third-party websites or resources. We are not responsible for:

The content, accuracy, or availability of external sites
The privacy practices or terms of service of external sites
Any damages or losses resulting from your use of external sites

Your use of third-party websites is at your own risk and subject to their respective terms and policies.

8. Disclaimers and Limitations of Liability

8.1 "AS IS" and "AS AVAILABLE" Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

Merchantability, fitness for a particular purpose, and non-infringement
Accuracy, reliability, or completeness of AI-generated content or educational materials
Uninterrupted, secure, or error-free operation of the Service
Correction of defects or errors
Freedom from viruses, malware, or other harmful components

8.2 No Professional or Academic Advice

The Service provides general educational content only and does not constitute:

Certification, accreditation, or formal qualifications

8.3 AI Limitations Disclaimer

WE EXPLICITLY DISCLAIM ALL LIABILITY FOR:

Inaccuracies, errors, or omissions in AI-generated content
Educational outcomes, examination results, or learning achievements
Decisions made based on AI-generated content or feedback
Any reliance you place on AI-generated educational materials

8.4 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or business opportunities
- Educational setbacks, failed examinations, or missed opportunities
- Emotional distress or reputational harm
- Cost of substitute services
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR EUR 100, WHICHEVER IS GREATER.

Your User Content or any content you submit to the Service
Your violation of these Terms
Your violation of any rights of another person or entity
Your inclusion of personal data in AI interactions contrary to our warnings and instructions
Any prohibited conduct or illegal activity

10. Modifications to the Service and Terms

10.1 Service Modifications

We reserve the right to:

Modify, suspend, or discontinue the Service or any features at any time, with or without notice
Change pricing, features, or functionality
Impose limits on certain features or restrict access to parts of the Service

We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

Upon termination, all your personal data and User Content will be immediately and permanently deleted in accordance with our Privacy Policy and GDPR requirements.

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to:

Violation of these Terms
Prohibited conduct as described in Section 4
Suspected fraudulent, abusive, or illegal activity
Extended periods of inactivity
At our sole discretion for any reason or no reason

11.4 Effect of Termination

Upon termination:

Your right to access and use the Service immediately ceases
All your data, User Content, and account information will be deleted (except where retention is required by law)
Any outstanding payment obligations remain due
Sections of these Terms that by their nature should survive termination shall survive (including Sections 6, 8, 9, 12, and 13)

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms and any disputes arising from or related to the Service shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law principles.

12.2 Jurisdiction and Venue

Any disputes, claims, or controversies arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Estonia. You irrevocably consent to the jurisdiction and venue of such courts.

12.3 Informal Dispute Resolution

Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at alex@tryblooming.ai. We will attempt to resolve the dispute in good faith through direct negotiation.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Blooming AI regarding the Service and supersede all prior agreements, understandings, and representations.

13.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

13.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Blooming AI.

13.4 Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section shall be null and void.

13.5 No Agency

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Blooming AI.

13.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, governmental actions, internet or telecommunications failures, or failures of third-party service providers.

13.7 Language

These Terms are written in English. In the event of any conflict between an English version and a translated version, the English version shall prevail.

All notices to you may be delivered by email to the address associated with your account or by posting to the Service. You may send notices to us at alex@tryblooming.ai.

Notices shall be deemed delivered:
